1. Acceptance of Terms

By accessing and using the SmartSpace platform (the "Service") provided by VividTech AS, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Service Description

VividTech AS provides SmartSpace, a multi-tenant SaaS platform for managing smart lockers, package deliveries, and secure storage solutions. Our Service includes locker management, package tracking, automated notifications, and related features.

3. User Accounts and Access

Access to our Service is provided through third-party identity providers such as Microsoft Entra ID (formerly Azure Active Directory). We do not offer direct user registration. You are responsible for maintaining the confidentiality of your identity provider credentials and for all activities that occur under your account.

Authentication Requirements:

• You must authenticate using a supported third-party identity provider (such as Microsoft accounts)
• You must be at least 18 years old to access the Service
• You are responsible for managing your identity provider account security
• You must notify us immediately if you suspect any unauthorized access to your account

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Use the Service to transmit malicious code or harmful content
• Impersonate another person or entity
• Collect or harvest information about other users without their consent

5. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by VividTech AS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

6. User Data and Privacy

Your use of the Service is also governed by our Privacy Statement. We collect, use, and protect your personal information as described in our Privacy Statement. By using the Service, you consent to our collection and use of your data in accordance with our Privacy Statement.

7. Multi-Tenant Services

VividTech AS operates SmartSpace as a multi-tenant platform. Each organization ("Tenant") has isolated data and access controls. Tenant administrators are responsible for managing user access and permissions within their organization. You acknowledge that Tenant settings and policies may impose additional restrictions on your use of the Service.

8. Fees and Payment

Certain features of the Service may require payment of fees. You agree to pay all applicable fees as described in your service agreement. All fees are non-refundable unless otherwise stated. We reserve the right to modify our fees upon reasonable notice.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may contact us or use the account deletion features in the Service.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. VividTech AS does not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy or reliability of any information obtained through the Service.

11. Limitation of Liability

To the maximum extent permitted by law, VividTech AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred from the use of any content posted, transmitted, or made available through the Service

12. Indemnification

You agree to defend, indemnify, and hold harmless VividTech AS, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Norway.
